Hate to be the wet blanket on any party but, I'm afraid this law will pass. And more crazy stiff laws on drunk driving as well. How about this: your car, in your driveway, you on your propery drinking, don't go near your car! They want it to be you can get charged with drunk driving. As far as the smoking thing goes. Many people inlcuding myself, when I smoked, threw their butts out the window. That can cause a fire if we are in a drought. Also as a biker, I do support the new proposed law, I don't want to get hit with butts while riding my motorcylce 60 mph down a highway. It can HURT! But in a way, I do support people throwing their cigs out the window, it makes me $$$$ every week. One of my accounts insists that all butts be blown off sidewalks/parking lot, in return I get paid a good decent amount to do it.

On three separate occasions, I have had airborne cigarettes come my way and into my car via the convertible top. It's not safe at 65mph to have to determine if your vehicle's back seat is on fire. I will confess that in one of those cases we immediately passed the thrower and my backseat passenger released their soda backwards into his front girlle. I'm not a vengeful man, but I certainly didn't yell at my passenger for that one.

My biggest beef with these laws is who the fuck do they really protect? I don't know, maybe I'm cynical, but when these smoking bans first came into effect they were justified with ridiculous statements like curbing smoking will reduce healthcare costs. Well, ummm, maybe, but when some big fat fuck with diabetes and heart attack waiting to happen tells me he's concerned about MY health, I have to raise an eyebrow. 50% of this country is morbidly obese; less than 25% of us smoke. So wait, half the country can LITERALLY eat themselves to death, but I can't have a smoke? Umm, ok. PLUS, it seems here in NYC that the anti-smoking nazis are now eating their words. Now they're complaining that the noise from the smokers outside the bars and restaurants bothers them at night. IF YOU'RE NOT AT THE BAR, WTF DO YOU CARE IF WE'RE SMOKING IN IT?? You ban our smoking, and you're not even out at the bar?? MY FAVORITE are the signs in the city that say, for example "NO SMOKING WITHIN 50 FEET OF BUILDING ENTRANCE." F-U, signs like that make me light up. I've been walking by buildings in midtown, WALKING BY, and have been approached by security guards attempting to enforce these stupid rules. Protect your rights, they cannot control what goes on on the public streets!!! Sorry for the rant, but this is one of the few issues I am quite passionate about.

Well their reasoning is simple. In America you cannot knowingly operate a workplace that exposes employees to known health risks without some sort of protection. They see studies that say working 5 times a week in a smokey environment can lead to health problems. People still debate the second-hand smoke issue, but the fact remains that the 'if you don't want to take the risk, don't go to the bar' logic won't hold up, because there are people who HAVE to be there; the staff. In America we also don't buy the cry of 'they chose that job.' In very American fashion (we try at least), every American is guaranteed reasonable safety at work. So, if you're the council of bar owners, which do you think will kill business more, asking people to step outside to smoke, or requiring your slinky blonde bartender to flirt and pour whiskeys while wearing a respirator? My personal feeling on all of it is, we may be perilously close to reaching a point where daily human life is so sterile and so free of threats that we will lose our resistances and resiliencies to even survive in nature. We will have rendered our species only suitable for surviving in a controlled and regulated artificial environment. That said, I still think my bartender friends have the right to BOTH remain as bartenders AND be promised that their work will not knowingly give them a disease.

I couldn't give a shit about what laws are passed, I'm going to do my thing anyway. I do feel strongly about people flicking lit cigarette butts from a moving car, that is so irresponsible, it is like walking away from a camp fire in the woods, it's totally unacceptable. All it takes is one tiny ember to start a fire, mix in a good wind, and some dry tinder, you've got yourself a brush fire. Now firemen have to come out and risk their lives not to mention possible property damage all because someone is too lazy to extinguish THIER cigarette! Not that I agree with it, but I can honestly see why the government feels the need to push these stupid laws down our throat. Stupid people=stupid laws!!

I agree with the ban on smoking in the workplace, but that does not justify the ban on smoking in bars based on the flawed logic that the bar is someone's workplace. Then they should allow bar owners to decide whether to allow smoking or not. Then the patrons AND THE STAFF can decide where they want to work and/or drink at that particular establishment. Look, people that work in slaughterhouses know they can lose their limbs, cops know they can be gunned down at any moment in the street. These are occupational risks, just like the smoking. I agree that the laws are totally out of control tying to protect us from ourselves. I do not doubt the day will come when we are required to wear helmets when driving or taking the bus. Still doesn't explain how these gluttonous fuckers are allowed to eat themselves to death. I smoke a pack a day and I'm the devil to some ignorant bastard eating 3 meals a day at McDonalds. It's more socially acceptable to be fat and lazy than smoke. Un-freakin-real. Hell, I bet a 'smoking only air carrier' would make millions (damn FAA would never allow it). I'd have 2 sections, regular and ultra!!
